These Terms of Use (the “Terms”) govern access to and use of svitli.agency (the “Website”). The Website is administered by the team operating under the Svitli Agency brand (“we”, “us”, the “Agency”).

By visiting the Website or using any of its functions, you confirm that you have read, understood and accepted these Terms. If you do not agree with them, please stop using the Website.

2. Purpose of the Website

The Website provides information about Svitli Agency, our services, working methods, team, case studies, articles, indicative pricing and contact methods. Website materials are provided for general information and presentation purposes.

Unless expressly stated otherwise, information on the Website, including descriptions of services, timeframes, results, rates or “from” prices, does not constitute a public offer, warranty or unconditional commitment by the Agency. The final scope of work, timetable, price, payment terms, rights in deliverables and other terms of a project are set out in a separate proposal, agreement, invoice or other document agreed by the parties.

Submitting an enquiry through the Website does not automatically create a contract and does not require the Agency to accept a project. Before entering into a separate agreement, we may request further information, suggest a different form of cooperation or decline an enquiry.

You may use the Website if you have the legal capacity required to do so. If you act on behalf of a company or another person, you confirm that you are authorised to represent them and provide the relevant information to us.

4. Permitted use

You may browse the Website, use its functions, submit enquiries and upload materials only in a lawful manner and in accordance with these Terms.

You may use Website materials for personal review or internal evaluation of a potential engagement with the Agency. Any other use requires our prior written permission unless it is expressly permitted by law.

When using the Website, you must not:

  • violate applicable law or the rights and legitimate interests of others;
  • attempt to gain unauthorised access to the Website, servers, accounts, databases or connected systems;
  • interfere with the Website, circumvent technical restrictions, test vulnerabilities without permission or impose an excessive load;
  • transmit malicious code, viruses, spam, phishing messages or other harmful content;
  • use automated means to collect, copy or index Website content at scale unless permitted by law or our written authorisation;
  • impersonate another person, knowingly provide false information or use another person’s contact details without a lawful basis;
  • copy, publish, sell, license, modify or create derivative materials from Website content in breach of intellectual-property rights;
  • use the Website or its content to create a product or service that misrepresents an affiliation with Svitli Agency.

When you submit an enquiry, message or file, you confirm that:

  • the information is accurate and current to the best of your knowledge;
  • you have the right to provide the data and materials and do not infringe third-party rights;
  • the materials do not contain unlawful, harmful, discriminatory or defamatory content or malicious code;
  • you are not disclosing another person’s confidential information without proper authority.

You grant us a limited, non-exclusive and royalty-free permission to receive, store, copy and use submitted materials internally only to the extent necessary to review your enquiry, prepare a proposal, provide requested services, maintain security and comply with legal obligations. This permission does not transfer ownership of your materials to us.

Unless expressly stated otherwise, the Website and its design, structure, source code, text, graphics, video, logos, names, brand elements, presentations and other materials are owned by Svitli Agency or lawfully used by us.

Making materials available on the Website does not transfer intellectual-property rights to users. You must not reproduce, distribute, publicly display, translate, adapt, sell or otherwise use these materials beyond what is allowed by these Terms or applicable law without the rights holder’s prior written permission.

Trade marks, logos, names and materials belonging to clients, partners or other third parties remain the property of their respective rights holders. Their appearance in a portfolio or case study does not grant any rights to Website users.

8. Case studies, results and professional information

Case studies, metrics and results described on the Website relate to specific projects and circumstances. They do not guarantee the same outcome for another project. Results may depend on the market, budget, competition, product condition, client actions, technical limitations, third-party platforms and many other factors.

Articles, checklists, recommendations and other Website materials provide general information and do not constitute legal, financial, tax or other specialist advice. You should consult an appropriately qualified professional before making decisions in those areas.

We may restrict or block access to the Website or particular functions where we reasonably believe that a user has breached these Terms, applicable law or the rights of others, or presents a threat to the Website or connected systems.

15. Governing law and disputes

These Terms are governed by the laws of Ukraine. The parties will attempt to resolve disputes relating to the Website through good-faith negotiations. If no resolution is reached, the dispute will be submitted to a competent court in accordance with the jurisdiction rules established by Ukrainian law.

Where mandatory consumer-protection rules or other provisions that cannot be varied by agreement apply to you, nothing in these Terms limits your rights under those provisions.
